If You Agree But Have No Defence
If you want to pay back the money but can’t afford to pay the full amount, make a reasonable monthly payment plan that you can afford to keep up.
- If you have just one or other unsecured debts and can afford a minimum payment of least £100 per month for five years then an IVA for an individual or a CVA for a limited company can stop the bankruptcy/winding up proceeding. (We can arrange this)
- Your creditor may agree to have you put a charge on your home if your current debt is unsecured. This would turn it into a secured debt and stop the bankruptcy process. Make sure if you do this, you put in conditions that prevent them from immediately forcing you to sell the property to release the money.
- Bankruptcy could be the right choice if the debt is just too much even for an IVA payment plan. (you would require expert advice before choosing this option as when the official receiver gets hold of your case they have ways of looking in to your financial past that you are unaware of).

Statutory Demands
Winding up Petitions
If you receive a Winding up petition it will have on it the debt the petitioner says you owe and the date the court is going to hear the Petition.
Company Demands
We determine if there is potential liability on the part of our client. We vigorously defend against any payment or settlement.
County Court Judgment
We will be attending court sessions to get the final resolution for the case.
